1. Acceptance of Terms

By accessing, using, or submitting an order on SongBanalo (“Platform”, “we”, “us”, or “our”), you (“User”, “you”) explicitly agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our service.

2. User-Submitted Content & Sole Liability (CRITICAL)

You acknowledge and agree that you are solely and entirely responsible for all content, information, names, memories, inside jokes, and text prompts submitted by you during the song creation process.

3. Prohibited & Unlawful Content (Zero Tolerance)

You agree NOT to submit any prompt, text, or memory that contains:

• Abusive, obscene, vulgar, sexually explicit, or pornographic material.
• Hate speech, racism, casteism, religious intolerance, or discrimination of any kind.
• Defamatory, slanderous, harassing, threatening, or extortionate language directed at any individual or organization.
• Content involving minors in any harmful, illegal, or inappropriate context.
• Infringement of third-party intellectual property, privacy, or publicity rights without explicit consent.
• Any material promoting violence, self-harm, terrorism, or unlawful acts under Indian or applicable local laws.

SongBanalo reserves the right to automatically flag, refuse generation, or terminate access for any order violating this policy without refund.

4. Indemnification & Hold Harmless

You agree to defend, indemnify, and hold harmless SongBanalo, its creators, operators, affiliates, and partners from and against any and all claims, liabilities, damages, losses, costs, or legal expenses (including reasonable attorneys' fees) arising out of or related to:

• Any content or text submitted by you that causes harm, distress, or legal action from third parties or the song recipient.
• Your violation of any applicable law, rule, or regulation.
• Your misuse or sharing of generated songs in a defamatory or unlawful manner.

5. AI Generation Disclaimer & Nature of Service

Songs and lyrics are synthesized algorithmically using generative artificial intelligence. While we strive for musical excellence, creative interpretation and phonetic pronunciations may occasionally vary. Generated songs are intended for personal entertainment and gifting purposes only.

6. Payments & Non-Refundable Policy (Customized Services)

Because SongBanalo provides bespoke, individualized creative services tailored specifically to recipient names, relationships, and personal memories provided by the user, all sales are strictly final. Once an order is placed and generation commences, songs are exempt from returns, cancellations, or refunds, as detailed in our Cancellation & Refund Policy.
